We are not legally required to appoint a data protection officer.

2. Hosting and server log files

This website is hosted by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. Cloudflare also provides the DNS management of our domain. When pages are accessed, Cloudflare automatically processes technical data transmitted by your browser:

• IP address
• date and time of access
• page or file requested
• browser and operating system (user agent)
• previously visited page (referrer)

Purpose and legal basis

Processing serves the delivery, stability and security of the website. The legal basis is our legitimate interest in a secure and functional service (Art. 6(1)(f) GDPR). A data processing agreement is in place with Cloudflare (Art. 28 GDPR). Cloudflare is certified under the EU-US Data Privacy Framework; the transfer to the USA is based on the European Commission's adequacy decision (Art. 45 GDPR). Log data is only stored as long as necessary for these purposes. More information: cloudflare.com/privacypolicy.

3. Storing your language choice

On your first visit we show the site in the language set in your browser (German, otherwise English); this setting is only read, not stored. If you switch between German and English yourself, we store this choice in your browser's local storage (localStorage, entry “capitalife_lang”) so that the site appears in your language on your next visit. The information does not leave your device and is not used for any other purpose. Storing it is strictly necessary for this function you requested (§ 25(2) no. 2 TDDDG). You can delete the entry at any time in your browser settings.

4. Fonts

The fonts used are delivered together with the website by our host. No connection to servers of Google or other font providers is made.

5. Contact by email

If you email us, we process your details (e.g. name, email address, content of the message) to answer your enquiry. The legal basis is Art. 6(1)(b) GDPR where a contract or pre-contractual questions are concerned, otherwise our legitimate interest in answering (Art. 6(1)(f) GDPR). We delete the data once the enquiry has been dealt with and no statutory retention obligations apply. Emails are processed via IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany; a data processing agreement is in place with the provider.

6. Waitlist

If you join the waitlist, we process your email address, the chosen language, the time and the wording of your consent in order to inform you about the launch and early access. The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time with effect for the future by emailing info@capitalife-invest.de.

The data is transmitted via the form service Web3Forms, offered by Web3Creative, Kerala, India, with servers in the USA. Web3Forms forwards the details to us by email and, according to its own statement, does not store submissions; server logs there are deleted about every two months. There is no EU adequacy decision for India or for this provider in the USA, and no data processing agreement is in place. There is therefore a risk that authorities there may access the data and that your rights may be harder to enforce. The transfer therefore only takes place on the basis of your explicit consent (Art. 49(1)(a) GDPR).

We store your details until you withdraw your consent or the waitlist ends, and delete them afterwards. If you reply to our early access email, we additionally process your name and, if provided, your phone number in order to contact you by email or phone (Art. 6(1)(a) GDPR). We delete these details after withdrawal, at the latest 12 months after the launch or as soon as it is clear that it will not take place.

7. Your rights

You have the right to:

• access to your data stored by us (Art. 15 GDPR)
• rectification of inaccurate data (Art. 16 GDPR)
• erasure (Art. 17 GDPR)
• restriction of processing (Art. 18 GDPR)
• data portability (Art. 20 GDPR)
• withdraw consent given, with effect for the future (Art. 7(3) GDPR)

Right to object

You can object at any time, on grounds relating to your particular situation, to processing of your data based on our legitimate interest (Art. 6(1)(f) GDPR) (Art. 21 GDPR).

Right to lodge a complaint

You can lodge a complaint with a data protection supervisory authority, in particular in the member state of your habitual residence, place of work or place of the alleged infringement (Art. 77 GDPR). The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany. For any request, an email to info@capitalife-invest.de is sufficient.

8. Other

You are not obliged to provide us with personal data. Without the technical connection data (section 2), however, the website cannot be displayed. No automated decision-making including profiling (Art. 22 GDPR) takes place. We update this notice when the website or the legal situation changes.
